Terms of Sale

These Terms of Sale (hereinafter "ToS") apply to any subscription to the paid offerings of the Walo service provided by Houssem Ben Ghorbel, Auto-Entrepreneur (ID 1981345N), hereinafter "the Provider".

1. Purpose

These ToS define the conditions under which the Provider grants the Merchant (hereinafter "the Client") access to the paid features of the Walo Service, a platform for creating and managing digital loyalty cards for Apple Wallet and Google Wallet.

2. Offers and Pricing

Available offers and their pricing are displayed on the Pricing page of the Site. Prices are listed in Tunisian Dinars (TND), Euros (EUR), or US Dollars (USD) depending on the Client's location, and are exclusive of taxes.

The Provider reserves the right to modify its pricing at any time. Price changes take effect at the beginning of the next billing period following notification to the Client.

3. Subscription

Subscription to a paid offer is completed online through the Site. The Client selects their offer and proceeds to payment. The subscription is effective upon payment confirmation.

4. Payment Terms

  • Payment is made by bank card or any other payment method offered on the Site
  • Billing is monthly or annual, depending on the option chosen by the Client
  • Payments are processed by a secure payment provider compliant with PCI-DSS standards
  • For annual payment, the total amount is charged in a single transaction

5. Renewal and Cancellation

5.1 Automatic Renewal

Subscriptions are automatically renewed at the end of each billing period, unless cancelled by the Client before the renewal date.

5.2 Cancellation by the Client

The Client may cancel their subscription at any time from their account settings. Cancellation takes effect at the end of the current billing period. The Client retains access to the Service until that date.

5.3 Cancellation by the Provider

The Provider may cancel the subscription in the event of a violation of the Terms of Use or these ToS, after a formal notice that has remained without effect for 15 days.

6. Right of Withdrawal

In accordance with applicable legislation, the professional Client has a 14-day withdrawal period from the date of subscription, by contacting the Provider at contact@getwalo.com.

If the Client has expressly requested the immediate commencement of the Service during the withdrawal period, they acknowledge losing their right of withdrawal for services already performed.

7. Provider's Obligations

  • Provide the Service in accordance with the description of the subscribed offer
  • Ensure maintenance and proper functioning of the Service
  • Inform the Client of any substantial modifications to the Service

8. Client's Obligations

  • Pay the price of the subscribed offer at the scheduled deadlines
  • Use the Service in accordance with the Terms of Use
  • Keep their payment information up to date

9. Limitation of Liability

The Provider's liability is limited to the amounts actually paid by the Client during the 12 months preceding the event giving rise to liability.

The Provider shall not be held liable for indirect damages, loss of revenue, customers, or data.

10. Personal Data

Data collected within the commercial relationship is processed in accordance with our Privacy Policy.

11. Force Majeure

The Provider shall not be held liable in cases of force majeure as defined by Tunisian jurisprudence (natural disasters, widespread internet outages, acts of war, etc.).

12. Applicable Law and Disputes

These ToS are governed by Tunisian law. In case of dispute, the parties agree to seek an amicable solution. Failing agreement, the competent courts of Tunis shall have exclusive jurisdiction.
