These Terms of Use (hereinafter "ToU") govern access to and use of the website getwalo.com and the Walo service (hereinafter "the Service"), operated by Houssem Ben Ghorbel, Auto-Entrepreneur (ID 1981345N).
By accessing the Site or using the Service, you accept these ToU without reservation.
1. Definitions
- "User": any natural or legal person who accesses the Site or uses the Service.
- "Merchant": a User who creates an account to manage loyalty cards.
- "End Customer": a consumer who signs up for a Merchant's loyalty card.
- "Card": a digital loyalty card created via the Service, compatible with Apple Wallet and Google Wallet.
2. Description of the Service
Walo is a platform that allows Merchants to create and manage digital loyalty cards that their End Customers can add to Apple Wallet or Google Wallet. The Service includes:
- Creation and customization of loyalty Cards
- Stamp/points and rewards management
- Push notification sending
- Analytics dashboard
- QR scanner for visit validation
3. Registration and Account
Using the Service as a Merchant requires creating an account. You agree to:
- Provide accurate and up-to-date information
- Maintain the confidentiality of your login credentials
- Immediately notify any unauthorized use of your account
You are responsible for all activity carried out through your account.
4. Merchant Obligations
The Merchant agrees to:
- Use the Service in accordance with the law and these ToU
- Comply with applicable data protection regulations
- Not use the Service for fraudulent, illegal, or harmful purposes
- Inform their End Customers about the existence and terms of their loyalty program
- Honor the rewards promised in their loyalty program
5. Intellectual Property
The Service, including its software, interfaces, text, graphics, and logos, is the exclusive property of Houssem Ben Ghorbel. Any unauthorized reproduction is prohibited.
The Merchant retains ownership of their content (logo, text, images) uploaded to the Service and grants Walo a limited license to display it within the Service.
6. Service Availability
We strive to keep the Service available 24/7. However, we do not guarantee uninterrupted availability and shall not be held liable for interruptions, whether planned (maintenance) or not.
7. Limitation of Liability
The Service is provided "as is". To the extent permitted by law:
- Walo does not guarantee that the Service will meet all your requirements
- Walo shall not be held liable for indirect damages, data loss, or loss of earnings
- Walo's total liability is limited to the amounts paid by the Merchant in the last 12 months
8. Suspension and Termination
Walo reserves the right to suspend or terminate an account in case of violation of these ToU, without notice in case of serious violation. The Merchant may delete their account at any time from the Service settings.
9. Data Protection
The processing of personal data is described in our Privacy Policy.
10. Modification of ToU
Walo may modify these ToU at any time. Changes take effect upon publication on the Site. In case of substantial changes, we will inform you by email at least 15 days before they take effect.
11. Applicable Law and Disputes
These ToU are governed by Tunisian law. In case of dispute, the parties agree to seek an amicable solution. Failing agreement, the competent courts of Tunis shall have exclusive jurisdiction.
